The High Court in Delhi directed the pension of the disability to a retirement officer’s pensioner and allocated the Armed Forces Tribunal (AFT), who rejected her claim because her hypertension was attributed to obesity.
The bench of justice C. Hari Shankar and the judiciary OM Prakash Shukla noted that the tribunal was not “justified to draw, in itself, the causal link between hypertension and the form of obesity suffering from the petitioner”.
“It is well known that every obese person does not suffer from hypertension and any person suffering from hypertension does not necessarily have to be obese,” said Lavička in its 26th September.
The petitioner, Mrs. Drupadi Tripathi, who joined the army in November 1969 and retired in July 2006 after more than 36 years of service, was released in the Low Medical category. The Medical Release Council has noticed that it suffers from obesity with disabilities rated at 1-5% and hypertension rated 30%.
After her retirement, Mrs. Tripathi asked for retirement of the disability, which was denied. Then she turned to the stern in 2018. The Tribunal, however, rejected her request and noted that it was previously found to suffer from obesity and hypertension and that it was recommended to reduce its weight, but instead its weight increased.

The Center advisor stated that the weight of the petitioner was 84 kg, which was grossly above the prescribed weight of 52 kg.
However, the court ordered the center to release the pension of Mrs. Tripathi’s disability from the date of its release from the service together with the arrears in twelve weeks.
