Cockroach Janata Party (CJP) activist Abhijeet Dipke, who was detained at the residence of NCP-SCP spokesperson Anish Gawande ahead of the ‘Tiranga’ march on Friday, will be produced before a Special Executive Magistrate (SEM).
“Abhijeet is arrested and will be produced before the SEM court. His location is still unknown, lawyers have not met,” wrote CJP Legal Director Ratna Singh early on Saturday X, adding that he would be produced before the court around 12 noon.
Why was Abhijeet Dipke detained?
Dipke was detained by the Delhi Police on Friday when he was about to participate in the ‘Lehra Do Tiranga’ yatra organized by the CJP at Connaught Place Central Park on Friday.
According to the Bar and Bench, Dipke was detained under section 126/170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
Section 126 relates to security for the preservation of the peace and Section 170 allows for “arrest to prevent the commission of cognizable offences”.
Two notices were issued to Dipke
The Delhi Police has issued two notices to Abhijeet Dipke citing restrictions under Section 163 of the BNN and a previous undertaking to maintain peace, reports PTI.
“We are remanding you. Section 163 is applicable in Connaught Place. You are under arrest,” said a police official as he informed Dipke of the arrest.
Section 163 of the BNSS is a preventive provision applied by law enforcement authorities (it replaces the former Section 144 of the Consumer Protection Act) in order to maintain public order and prevent imminent threats or dangers.
Under Section 163 of the BNSS, public assemblies or gatherings of five or more persons, processions, demonstrations, demonstrations and dharnas without prior written permission are prohibited.
According to PTI, one of the two notices was issued by the New Delhi district under the Delhi Police Act, ordering Dipke not to visit Central Park in view of the restrictions imposed under Section 163 of the BNSS.
The second notice was issued by the South-West Delhi district and referred to an earlier preventive action involving Dipke, Ashutosh and Saurav, who were detained at the airport ahead of the October 10 protest against Chief Election Commissioner Gyanesh Kumar.
The notice referred to the bond that they should not disturb the public peace for a period of one year.
A day after the CJP leaders’ arrest, on October 10, the organisation’s legal chief informed that an executive magistrate had released Abhijeet Dipke, Saurav Das and Ashutosh Ranka on the condition: “no breach of peace for one year”. The Delhi Police said that the “surety bond”. ₹50,000 were also signed.
