Telangana High Court orders private medical college to refund student’s tuition fees as university cancels admission

The Telangana High Court has ordered a private medical college to refund the entire tuition fee of ₹3.32 lakh paid by student D. Shabari Priya, who was initially admitted to the BHMS course but the same was canceled due to her NEET score.

Cancellation of admission, irrespective of any justification, cannot result in unjust enrichment of the institution by withholding the amount paid in tuition for a seat in which the student was not allowed to continue, Justice Juvvadi Sridevi said. The student has been allotted seat in BHMS course at Guru Nanak Homoeopathic Medical College and Hospital, Ibrahimpatnam in 2025 under management quota based on letter of allotment from Kaloji Narayana Rao University of Health Sciences.

However, the university eventually canceled the admission saying that she scored 128 marks in NEET instead of the required 144 marks. The petitioner cannot be forced to bear the financial consequences of any mistake by the university, the judge said.
