The Supreme Court is scheduled to hear on Thursday (October 15, 2026) a joint petition filed by the Leader of the Opposition, led by Leader of the Opposition (LoP) in the Lok Sabha Rahul Gandhi, seeking full and complete disclosure of the “files, agenda, minutes, notes and objections” recorded by Election Commissioners Sukhbir Joshi Sandhu (IR Singh Sandhu and Vivek), which have so far been deleted3. millions of voters across India.
The Bench is chaired by Chief Justice of India Surya Kant and Justice Joymalya Bagchi.
Mr. Gandhi sought a judicial review of the Election Commission’s records to verify whether Chief Election Commissioner Gyanesh Kumar acted arbitrarily and unilaterally during the ongoing SIR.
The Congress leader said the petition highlights serious concerns regarding the integrity of the election process itself under the SIR. He said the SIR witnessed a violation of the constitutional right of eligible citizens to be registered as voters and exercise their right to vote.
Mr. Gandhi sought an interim order from the Supreme Court to stay the SIR pending consideration and determination of the issues raised in the petition to protect the rights of eligible voters and preserve the integrity of the electoral process.
“The right to vote belongs to every eligible citizen irrespective of political affiliation and its protection is a constitutional imperative that transcends party politics,” the petition represented by senior advocate AM Singhvi and filed through advocate Prasanna S. said.
Other petitions challenging the October 10 police crackdown on protesters are also listed before the same bench.
