The All India Students’ Association (AISA) said on Monday (Oct 19, 2026) that its president Neha Bora had challenged a notice in the Delhi High Court asking her to enter into an amicable union and that her lawyers would seek an urgent hearing before the chief justice.
Ms Bora was taken into preventive custody on October 16 when she was on her way to participate in the ‘Lehra Do Tiranga’ march of the Cockroach Janata Party (CJP). She was released on October 17.
The Delhi Police (New Delhi District) issued a notice under Sections 126 and 130 read with Section 135(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS) on October 18. On October 17, she was directed to appear before the Special Executive Magistrate (SEM), District New Delhi, on October 19 at 2 pm. It asked her to furnish a personal bond of ₹10,000 with one surety “for maintaining peace during the investigation”.
AISA said Ms Borova’s petition calls for the immediate suspension and withdrawal of the notice. He argues that the notification is prima facie ambiguous and factually incorrect and that it violates Articles 19 and 21 of the Constitution. Her legal team led by Abhik Chimni, Pranjal Abrol and Moksha will also appear before the SEM to respond to the notice and inform the court about the Supreme Court’s summons.
AISA described the notification as a calculated attempt to curtail the right to peaceful protest. It said the Delhi Police had repeatedly misused Section 163 of the BNSS (formerly Section 144) during protests demanding the resignation of Chief Election Commissioner Gyanesh Kumar, repeal of the Special Intensive Review (SIR) and repeal of the Election Commission Appointments Act, 2023. It alleged that the government had deployed over 40,000 paramilitary personnel, closed metro stations and suspended internet connections to suppress protests.
