
Mistry’s petition states that the appointment of Singh and Srinivasan and their subsequent actions, “including voting on Circular Resolution No. 671, is in flagrant violation of the express terms of the trust deed. This conduct amounts not only to mismanagement of the trust but also to the commission of malfeasance with respect to the trust. Furthermore, the actions of the appellants (Veniva) Sh. constitute the offenses of cheating, fraud, misrepresentation and criminal trespass of trust,” Mistry’s petition said.
