Kerala HC granted anticipatory bail to the YouTuber

The Kerala High Court has granted anticipatory bail to YouTuber Muhammed Nihad alias Thoppi, who was accused of hosting a live stream on YouTube channel ‘Mrz Shameer’ and allegedly posting offensive content about the complainant.

Judge A. Badharudeen reviewed the video and found that there was no indication that Mr. Nihad had directly uttered any obscene words or made sexually-tinged remarks against the victim. The court ruled that Mr. Nihad’s custodial interrogation was unnecessary in light of the allegations.

The prosecution before the Manjeri District and Regional Court alleged that the accused conducted a live broadcast for four hours and deliberately displayed photographs and videos of the complainant without her consent, made obscene, sexually colored and defamatory remarks, invaded her privacy and insulted her modesty.

The court granted pre-arrest bail on conditions including furnishing a bond of ₹1,000 with two solvency sureties, fully cooperating with the investigation, appearing before the investigating officer weekly and not leaving the state without the permission of the trial court.
