The High Court, which claimed that the right to motor roads was constitutional law, ordered the government to report on road safety and quality within one month.
The Devan Ramacandran justice bench has added orally that the right to travel is under the compass of the fundamental law compass in solving the non -sowing case due to potholes, poor road maintenance in Kerala and uncontrollable violations of traffic rules. The court quoted incidents as one in Thrissur, where the rider of two rounds that turned to avoid the pothole that was fatally hit by another vehicle directly in front of his mother to throw the light on the deteriorating road conditions.
These are not mere accidents and it should be opens. Yet the court still does not see specific actions, he added. Amicus Curiae in the case of Vinod Bhat said that only peripheral work has occurred, despite multiple court orders.
Engineer
The Court of Justice said that each road had a designated engineer who was Prima Facia responsible for ensuring its maintenance and preventing accidents due to potholes, and the hope that the parties, including the highest level, would proactively find feasible and permanent solutions. Specifically, she mentioned the expected increase in traffic during the imminent onam season.
Although the court had previously sought a comprehensive report on the security and quality of road traffic from the Public Work Department and Kochi Corporation, the government advisor was looking for another time to present the report. The matter was published for hearing the upcoming week.
