Judge Jayaskankaran Nambiar, Judge Judge, said on Saturday that the existing laws on the protection of animals and wildlife were anthropocentric nature and should be reimaginated to become ecologically focused, so all judges could interpret these laws more. He participated in the panel discussion “Environmental Policy and Law in Nilgiri Biosphere Reserve”, the third day of the Nilgiriscapes conference in Udhagamandalam, Nilgiris.

Justice Zambiar said that both the 1960s of the Interesting Animals and the Act on the Protection of Wild Animals from 1972, were both anthropocentric, because they “prefer human beings” over other species. “There is a sense of people’s domination over all other species,” he said.
The judge noted that the first truly ecological legislation that was approved in the country was the 2002 biological diversity.
“Conflict concepts”
“So we have a mixed bag of legislation we are invited to interpret. We have anthropocentric legislation, side by side with ecocentric. What is the philosophy to go to law?
JUSTICE NAMBIAR added that it is a little surprise that when the judges were invited to interpret these laws, their points varied depending on their live experiences. “So if you really want to have a uniform application and philosophy of laws, you need a re -presentation or a change in our legislation, covering all these areas and letting them focus ecologically,” he said.
Wilderness
The justice of Zambiar, referring to the Argentine feminist philosopher, Maria Cristina Lugones, said the “world travel” understanding that the “second”, which would be a wilderness, was also an important aspect of laws.
“She (Lugones) said it would be encouraging if everyone accepted access to the world traveler. In solving problems, especially with regard to conflicts and animals,” added justice Nambiar.
