
On a Supreme Court motion, late industrialist Sunjay Kapoor’s mother Rani and his wife Priya have agreed to mediate their family trust dispute. The Supreme Court today, May 7, sought the mediation of former Chief Justice of India (CJI) DY Chandrachud to help the two sides settle the family trust dispute.
Supreme Court Justices JB Pardiwala and Ujjal Bhuyan asked the parties to participate in the mediation proceedings with an open mind after giving their mutual consent. The Supreme Court said they are not allowed to make any public statements or post on social media about the dispute.
“It is a family dispute. Let it be confined to the family only. It should not be a source of entertainment,” the court said.
“We make it clear that this mediation is limited to family members only. We give one request to all parties before us that they are not allowed to testify publicly and not to go on social media. Since this is a family matter, their efforts should be to resolve the disputes as soon as possible and bring the matter to an end. We strongly believe that all parties should participate in the entire mediation process if they are interested and all are able to resolve everything with an open he thinks. matter before a mediator Otherwise it will be a long drawn-out lawsuit,” Live Law said.
The court acknowledged that both parties had agreed to mediate the family fund dispute and appointed DY Chandrachud as their mediator. The bench said, “All the lawyers appearing for the respective parties have very kindly agreed to go for mediation. In such circumstances as mentioned above, we appoint DY Chandrachud, former Chief Justice of India to act as mediator.”
“We will wait for the preliminary report from the mediator and then proceed with the matter,” the bench said, listing the matter for August.
‘You’re 80, that’s no age to fight’
Earlier, the court had told the late industrialist’s mother, Rani, that her age was not suitable to fight the legal battle.
The Supreme Court observed: “Why are you all fighting? You are 80. That is not an age at which your client can fight. Go to mediation once and for all, from A to Z. Otherwise it is a waste.”
“It will be in the interest of all parties involved if they go to mediation and try to resolve the disputes amicably and fairly… If necessary, we will hear the matter on its merits, but first we should try to persuade the parties to go to mediation.”
