US Midterm Election Results Impact on H-1B Visas: What Republican or Democratic Control Could Mean for Indians | Today’s news

US President Donald Trump and his Republican Party faced a crucial test on Tuesday (local time) as the results of the midterm elections began to come in, with control of Congress at stake. The outcome will be closely watched not only in the US but also in India as it could affect future H-1B visa policy. Indian-born recipients accounted for 69.9% of all approved H-1B petitions in FY 2025, according to USCIS data.

The election, which took place on November 3, could affect the last two years of Trump’s presidency. Congress is currently controlled by Republicans, with an effective majority of 219–214 in the House of Representatives and a 53–47 majority in the Senate, including independents affiliated with each party. However, if Democrats gain control of Congress, their victory could make it more difficult for Trump to push his agenda.

How could mid-term US outcomes affect H-1B visas?

NDTV Profit recently reported that a Democratic victory could increase congressional control over immigration rules and put some Republican-backed proposals on hold, though major policy changes are unlikely. Even if Democrats win control of Congress, the result would not automatically reverse Trump’s presidential proclamations. The US president would also retain the power to veto legislation, making it more difficult for Democrats to enact major changes.

The shifting momentum would be particularly significant for H-1B visa holders as Trump has announced some drastic immigration measures after returning to the White House for a second term. These include a $100,000 fee on new H-1B visa applications, announced last September.

The charge faced legal challenges. According to Reuters, U.S. District Judge Haywood Gilliam blocked its implementation after finding that U.S. Citizenship and Immigration Services and the State Department failed to follow required rulemaking procedures. In a separate case, a federal judge in Boston previously ruled that the fee constituted an illegal tax that Congress had never authorized.

If Republicans retain control of Congress, they could push for legislation to give the fee a legal basis, while Democratic majorities in both chambers could block such efforts. Several Democratic-led states have challenged the fee in court, saying it could hurt local economies, universities, hospitals and technology businesses.

H-1B visa program

The H-1B program allows employers in the United States to hire foreign workers with training in specialized fields. The annual limit is 65,000 visas, and an additional 20,000 places are reserved for workers with higher education from American institutions. H-1B status is generally granted for an initial period of up to three years and can be extended for up to six years.

Before Trump implemented the $100,000 fee last year, employers typically paid between $2,000 and $5,000, depending on various factors. Defending the move, Trump said the program “was deliberately used to replace American workers, rather than supplement them, with lower-paid, lower-skilled labor.”

Some critics of the H-1B program have also said that the program is abused by several companies that replace American workers with cheaper foreign labor.
