HC refuses to quash proceedings against former Malappuram SP, two others in sexual assault case

The Kerala High Court refused to quash the Magistrate’s Court in the sexual assault case against former Malappuram SP S. Sujith Das and two other police officers.

The High Court dismissed the plea filed by Mr. Das, former Tirur DySP VV Benny and former Ponnani CI Vinod Valiyattotter seeking to quash the court proceedings against them.

The complainant alleged that the officers sexually assaulted her after she went to the police regarding a family dispute. The court ruled that the petitioners’ contention that prior permission from senior officers is required before an inquiry is ordered against them would not apply to serious cases such as sexual assault.
