‘Clerk, I order you to…’: Party throws papers, hurls expletives during hearing | Today’s news
“Mr bailiff. I order you to…,” the unruly litigant said during a High Court hearing on Friday after allegedly swearing and throwing his legal documents.
In a dramatic turn of events, the litigant was forcibly removed from the courthouse. The Supreme Court was hearing his petition challenging the order of the Allahabad High Court.
The incident occurred before a part-time bench comprising Justices KV Viswanathan and Alok Aradhe. Initially, the party to the dispute took an unusually confrontational tone.
Unruly behavior
“Mr. Judicial Officer. I direct you to order the registration of an FIR against ACP Lucknow,” said the litigant, who was wearing a black coat without a legal sash, addressing the bench.
“Are you commanding me? Commanding us?” asked a visibly surprised Judge Viswanathan.
“That’s all from me. It’s all on the record,” the litigant said, launching into unparliamentary expletives before allegedly blowing up his papers.
A security guard immediately intervened and overpowered him and removed him from the courtroom, allowing proceedings to continue.
No immediate order regarding the incident has yet been issued in open court.
According to a LiveLaw report, the bench remained calm and unresponsive during the episode. They continued with the remaining cases on the cause list.
The Trial Chamber allegedly took no action against the undisciplined petitioner for his conduct.
“…in view of the above condition of the petitioner and does not propose to take any action against him,” the court said. “On the merits of this case, we have perused the records, we find no good reason to interfere with the impugned judgment/order.
Not an isolated incident
In October 2025, a similar incident occurred when a lawyer tried to remove his shoe and throw it at former Chief Justice BR Gavaie during court proceedings.
The lawyer was escorted out of the courtroom by security personnel.
The Bar Council of India suspended his license and the Supreme Court terminated his membership. Later, LiveLaw reported that CJI Gavai insisted that no action would be taken against the accused lawyer.
