
The Jammu and Kashmir High Court on Monday quashed the detention of Aam Aadmi Party (AAP) lawmaker Mehraj Din Malik after eight months in jail, terming the administration’s move to invoke the Public Safety Act (PSA) as a “shortcut to circumvent the regular criminal law”.
“Invoking the provisions of the Personal Data Protection Act to detain the petitioner instead of prosecuting him appears to be an unauthorized act amounting to violation of the fundamental rights of the detainee,” Justice Mohammad Yousuf Wani said in the 88-page judgment.
