The High Court in Mumbai issued the Mahashtra government announcement of a petition that questioned its abolition of all birth certificates issued by Naib then after 11 August 2023.
The Nagpur bench of the Supreme Court issued an announcement to the government and its officials, including the main secretary and collectors, on September 9 and looking for their answers within two weeks.
The Government Resolution (GR) of 12 March this year and the subsequent order of 17 March ordered that all birth certificates issued Naib then after 11 August 2023. The High Court listened to the petition submitted by the Civil Rights Association (APCR).
The petitioners claimed that the GR and the subsequent order were “arbitrary, illegal and contrary to the registration of the Childbirth and Death Act, 2023, as well as Articles 14, 19 and 21 institutes”.
The Secretary General of APCR Shakir Shaikh said that the government directives had caused immense citizens to be immense and added that the order of 17th March canceled thousands of birth certificates without giving the opportunity to hear, violating the principles of natural justice.
This step caused extensive anxiety, especially among the poor and disadvantaged, because birth certificates are necessary to use key services such as Aadhaar, voters ID, school and passports, told the court. The case was argued by advocates Firdous Mirza, Sayed Owas Ahmed, F Kashif and Shoaib Inamdar.
The order to cancel their birth certificates was issued as a result of the demands of BJP leader Kirit Somaiya that thousands of false birth certificates were acquired by Bangladesh nationals to show up as Indian citizens.
