100% job placement guarantee not fulfilled: MBA graduate takes institute to court, gets full compensation | Today’s news
The Punjab Consumer Commission ordered the coaching company to refund the fees to the MBA graduate. The dispute was over a course advertised with the promise of “100% guaranteed placement”.
The Gurdaspur District Consumer Commission passed its order on September 16. He directed Eduinx Education Services to issue a refund ₹84,960 to Harish Malhotra, The Times of India reported.
The commission also appreciated ₹10,000 for mental stress and harassment. Other ₹5,000 was provided for his legal expenses, according to TOI.

Malhotra joined an online program covering Artificial Intelligence (AI) in Product Management. According to his complaint, his decision was influenced by an advertisement promising a guaranteed placement.
MBA graduate paid ₹84,960 through credit card on 12 July 2025. Completed the course and received the certificate on 24 November 2025.
However, Malhotra claimed that the promised contract never materialized despite repeated follow-ups. He said the company keeps extending its timelines. He then appealed to the commission for a refund and compensation.
Malhotra claimed that he remained unemployed for more than 10 months. He searched ₹6 thousand for financial loss and damage to the continuity of his career. He also asked ₹30,000 for legal expenses.
Eduinx denied the allegations and described itself as a training and career support platform. It argued that hiring decisions were made by employers rather than the platform.

The company said its guarantee covers interview preparation, profile improvement and contact with employers. It also alleged that Malhotra was involved in recruitment processes involving several companies.
Eduinx claimed to have turned down opportunities outside its preferred locations, Gurugram and Delhi-NCR.
The commission looked into whether these recruitment efforts lived up to the advertised promise. President Lalit Mohan Dogra and member BS Matharu found that no.
The bench distinguished between arranging interviews and actually securing placements. It said any warranty limits should be clearly disclosed during registration.
The commission also rejected unsubstantiated claims linking the result to the performance of the interview with Malhotra. Eduinx did not submit employer evaluations or communications indicating rejection on this basis.

WhatsApp messages showed that some vacancies were shared with him. However, the Commission found that these reports do not establish definitive job offers or successful placements.
“A mere suggestion of a vacancy cannot be equated with an offer of employment as promised. Neither a recruitment drive, a screening call or an interview can be considered equivalent to a successful placement,” the commission quoted TOI as saying.
“Therefore, even if we take the WhatsApp conversations at face value, the evidence falls short of the opposing parties meeting the substantial placement,” he added.

He found that the unfulfilled obligation constituted insufficient service. An insufficiently qualified placement guarantee was also an unfair business practice.
However, the commission refused ₹6k compensation claim as supporting documents were insufficient.
Payment must be made within 45 days of receiving a copy of the order. Otherwise, the refund bears interest at 9% annual interest on the deposit until actual repayment.
