In a judgment on Tuesday (May 12, 2026), the Supreme Court observed that a woman’s claim of independence in marriage and pursuit of professional excellence cannot be termed as “defiance” by her husband and in-laws.
A woman’s decisions, made on the basis of her professional obligations or for the welfare of her child or other fact of life, cannot be subordinated to the life choices of her husband or father-in-law.
“The expectation that a woman must always sacrifice her career and submit to the traditional notions of a dutiful cohabitant wife, regardless of her own aspirations or the welfare of the child, reflects a line of thinking that is archaic, ultra-conservative and cannot be accepted in today’s scenario where women lead various professions,” Justice Vikram Bench said from the front.
The court made the observations while dismissing an application filed by an army officer who accused his wife of cruelty and desertion. The Bench found the facts of the case “deeply disturbing” when it learned that the wife was only trying to set up her own dental clinic.
The court said she was expected to let her professional qualifications intrude and join her husband at a distance.
“A well-educated and professionally qualified woman cannot be expected to be confined only within the strict confines of marital obligations… A woman can no longer be treated as a mere appendage to her husband’s household and her independent intellectual and professional identity and aspirations must be accorded due trust and respect,” the court said.
