The Madras High Court ordered the Tamil Nada government to explain how the members of the Malayalian community in the Erode district were issued a certificate of the planned tribe (ST), although they were not eligible for such an advantage.
The first division of the bench of the chief judge Manindra Mohan Shrivast and the judiciary G. ARUL MURUGAN granted four weeks to present an explanation for four weeks and ordered the state government against Edwin Prabakar to ensure that it would be submitted on 23 October or earlier.
The orders were handed over to a dose of 10 written petitions submitted by those who were damaged against the rejection of their online request for certificates st. The petitioners added up to 14 St Certificates issued to other permanent residents of the Erode district.
Attorney S. Dooraisama represented one of the petitioners and told the court that the state government had issued the recommendation of Center 17 March 2025 to include the Malaysian community based in the Erode district under the planned list of tribes concerning Tamil Nadu.
Observing that mere recommendations could not become the basis for the issue of ST certificates, the bench of the main judge said that from now on people in Malaysal were located in Dharmapuri, North Arcot, Pudukkottai, Salem, South Arcot and Tiruchi in the districts.
Any change in the ST List concerning Tamil Nadu could only be made by the presidential order pursuant to Article 342 (1) and parliamentary enactment pursuant to Article 342 (2) of the Constitution. No such exercise has been carried out yet with regard to Malayalis staying in the Erode district, the judges said.
“We have found that current petitioners claim that the advantage of issuing a large number of such community certificates of persons belonging to the Malaysian community who are permanent residents of the Erode district. For illustration, 14 community certificates issued by authorities were attached from time to time.”
He continued his state: “The state government is awarded for four weeks to describe the answer. Obviously, under what circumstances, these community certificates attached to the petition and the above mentioned above were issued by the Erode District revenue division.”
