An official for the Indian police police service based in Assam, Gaurav Up fallsyay, was charged with harassment of minors. The Special Court in Assam recently ordered framing the accusation under the protection of children from sexual offenses (POCO) and other parts of IPC against Upephodyay in a six -year case.
The incident, including a fourteen -year -old girl, took place in December 2019, reported the PTI. The police case was registered in January 2020.
The Criminal Investigation Department (CID) has explored this case and subsequently submitted its accusation against an IPS official.
“Two incidents of sexual assault”
The Special Court stated in its order that the accused, who was “in the incident of the Police of Assam’s Karbi’s Anglong at the time of the incident,” two incidents of sexual assault on the survivors “occurred.
“The first attack appeared in Bungalo SP in Diph (city in Assam). The second attack took place in the hotel room, where the survivor stayed with his mother and brother,” the court quoted the news agency PTI.
The judge noted that, given that Upadhyay was Karbi Anglong SP at the time of the incident, this happened within the limits of his jurisdiction and control as a policeman who attracted the provisions (i) and (L) section 9 of the POŠO law and punished the same law under section 10.
“The power to kiss, touched its private parts”
The court’s order reportedly stated that the use of the “criminal force to kiss” the victim and “physical contact and progress” by the touch of its private parts – as indicated specifically the minor in its statement – leads to accusation pursuant to sections 354 and 354a of the Indian Criminal Code (IPC).
“Under the circumstances, the accusations according to Section 10 of the POCSO law and sections 354, 354A are framed by IPC,” the special judge ruled.
Section 10 of the POCSO law deals with impaired sexual attacks, while sections 354 and 354A IPC are intended for crimes related to attack or criminal forces on a woman with the intention of outraging her modesty or sexual harassment.

Gaurav UpipPyay said in his LinkedIn profile that he also has extensive experience in the information technology sector.
“It holds B.Tech in the field of information technology and MBA in IT and marketing from the Indian Institute of Foreign Trade, both in both technical and managerial areas,” he read the profile.
He added: “During almost six years in IT multinational companies such as IBM, Black Box Corporation and Dimension Data, he has excelled in roles involving account management, market segment analysis and business development in North India.”
