Two individual bike owners on Tuesday questioned the Bench Bench command to the Supreme Judge in Karnataka, who recently banned taxis by bike in the state.
The petitioners, represented by the head of lawyer Dyan Chinnapp, claimed that the Karnataka government could not violate the fundamental right to continue their business or select a taxi on a bike over a metro or bus.
They argued that the ban is not only contrary to the provisions in the Motor Vehicle Act, but also strictly affects their livelihood and public comfort.
The court order prohibits taxis by bike
In April, he ruled on one judge to the Karnataka High Court that taxis on the bike could not be allowed without proper announcements of the instructions pursuant to Section 93 of the Motor Vehicles Act.
It also banned the Ministry of Transport in registration of motorcycles as transport vehicles or their issuing permits for contractual transport.
The order was to be introduced from 16 June to the six -week delay period.
“The law allows the registration of two -wheelers as transport vehicles. If the status allows it, the state cannot suppress it by rejecting registration or permit,” Chinnappa said in court.
The contractual trolley includes different types of vehicles, including motor cabins that can range from two to six seats, he added.
Chinnappa further argued that the stopping of taxis on the bike in the last 7-10 days has led to chaos for everyday commuters. “The news showed how catastrophic this ban was for the public. It seems that the state did not completely know about ground reality,” he said.
“If there are security concerns, the state should be solved through politics – not a direct ban,” he said.
The bench also heard the appeal filed by OLA, Uber and Rapido against the order ban.
“The blanket of refusal to register the entire class of vehicles – such as motorcycles – is not supported by the motor vehicle law. The state cannot selectively deactivate the class by rejecting permit,” he said.
The High Court planned the matter for further hearing on June 25th.
