TN Govt ordered absentee registration of title deeds, certificates submitted by banks from 15th September

The Tamil Nadu government has issued an order mandating absentee registration to store title deeds and receipts submitted by banks and financial institutions from September 15 as part of the second phase of Anywhere registration.

The order was in line with a recent announcement in the Assembly by Minister for Business Taxes and Registration D. Logesh Tamilselvan that the government would issue appropriate orders to make absentee registration for depositing title deeds and takeover certificates submitted by banks and financial institutions mandatory.

In the first phase of Anywhere Registration, launched by Chief Minister C. Joseph Vijay on August 17, the state government has mandated registration of deeds relating to first sale of land by land promoters and first sale of flats by builders, along with subsequent deposit of title deeds.

The last regulation stated that banks and financial institutions routinely submit a deposit of title deeds for registration when securing real estate against loans approved by them. Similarly, upon repayment or fulfillment of a secured loan, a confirmation of acceptance is registered, which proves the fulfillment of the obligation.

Both of these transactions were institutional in nature and were carried out by banks and financial institutions in the normal course of their lending operations. Since the documents originate from regulated institutional entities and their authorized officials can be granted dedicated institutional access to the STAR (Simplified and Transparent Management of Registration) system, they are particularly suitable for a non-presence registration process.

The storage of title deeds and acknowledgment of receipt has already been made possible as part of absentee registration. Therefore, the obligation to register them through the system would be an extension and optimal use of the already created digital infrastructure by the registration department, not the introduction of a new category of registration, she said.

Under the new system, banks and financial institutions will be able to submit documents electronically without representing their officials to sub-registrars. This is expected to reduce physical burden and manual interface, facilitate faster processing, improve traceability of mortgage-related transactions and enable safe digital preservation of registered documents, the order added.
