The US Federal Court of Appeal said on Thursday that President Donald Trump could keep his tariffs using emergency powers. This decision comes after the administration questioned the previous decision that blocked most of its flagship policies.
The Court of Appeal for the Federal District in Washington approved the urgent request of its team, which stated that the stopping of tariffs would be “critical to the country’s national security”.
Trump faces several court disputes that claim that his tariffs “Liberation Day” exceeded what the law allows.
On Wednesday, the panel of three judges decided from the US international trade court that Trump had abused his powers through the International Emergency Economic Powers Act to declare the national emergency situation and set tariffs for imports from almost every country. The decision is the main strike of Trump, whose unpredictable business movements have shaken financial markets around the world.
The White House promises to fight with the Supreme Court
The US Court of Appeal celebrated the best White House business advisor Peter Navarro, who told reporters on Thursday: “I can assure you that the American people, that the Trump Agenda is alive, well, healthy and will be made to protect you, save your jobs and your factories.”
While Peter Navarro welcomed a temporary break for a decision, the White House was still feared that the Court of Appeal could still strike Trump’s customs policy.
White House officials said they were planning to continue the defense of the legality of their efforts to trade in the US Supreme Court and stated that if they were hundreds, Trump would simply chase the same fees through other authorities.
Press Secretary of the White House Karoline Leavitt said, “Other countries around the world have faith in Donald Trump … They probably also see how ridiculous this decision is … We intend to win, file an emergency appeal and expect this battle to fight at the Supreme Court.”
“America cannot work if President Trump – or other president – has their sensitive diplomatic or business conduct of the railway by activist judges,” she added. “In the end, the Supreme Court must end it because of our constitution and our country.”
