The Tamil Government on Wednesday (May 21, 2025) informed the Madras High Court of submitting a petition to the Supreme Court, which sought to move to the last interest (Pil), which is currently waiting for the High Court, and questioned the validity of state laws taken by the Governor to name Vice Presidents.
Previous before the summer holiday bench Justices Gr Swaminathan and V. Lakshminarayanan, head of the advisor P. Wilson, representing the Ministry of Higher Education Tamil Nadu, said the proposal for the transfer was submitted with regard to the interconnected cases waiting for the Supreme Court.
The Minister of Higher Education C. Samayamoorty also gave a memory before the Supreme Court and claimed that the petition was politically motivated because it was handed by Kutty, alias K. Venkatchalapath, who was Bharatiya Janata Party (BJP) in Tirunelvel.
Although the petitioner challenged state laws for 56 reasons, its primary statement was that state laws were contrary to Regulation 7.3 of the Commission for University Grants on minimal qualifications for the appointment of teachers and other academic employees at universities and universities, 2018.
The validity of Regulation 7.3 was in itself the subject of lawsuits waiting for the Supreme Court, the secretary said that it would be appropriate to transfer the current petition to the Supreme Court and to mark it together with the cases awaiting there.
The divisional bench was also informed that it was mentioned in front of the bench headed by the main judge of India (CJI) BR Gavai on 19 May 2025, which was looking for a timely list of transfer petition and that CJI orally asked the legal representative of the state government.
The Minister of Higher Education also stated that no serious urgency was involved in the case of the High Court without sufficient time for the state government to submit a detailed countermeasure that meets all 56 reasons.
He called on the division of the bench led by Judge Swaminathan to postpone the hearing of the petition until the Supreme Court filed the liquidation of the transfer petition.
