The Supreme Court on Monday (May 19, 2025) gave positive instructions facilitating Tamil over and Kerala to deal with long -term problems such as tree cutting that block access to the 125 -year MULPERIYAR dam, transporting materials to repair the approach roads and even induction of the main superstructure of the dam.
The bench headed by Judge Surya Kant gave Kerara to hand over the request filed by Tamil over the trees to cut the Ministry of the Environment and Forests in two weeks. The center was asked to keep a sanction within three weeks, subject to the relevant conditions.
In remarking that Kerala agreed to the transport of materials needed for six of the nine repair work that pointed out Tamil Nadu, the apex court said that it was almost no “justification” not to allow the transport of the material needed for the remaining three work.
The court allowed the executive engineer to be present with the government of Kerala when repairs are carried out by the government of Tamil Nadu.
For the objections of the keral, that the materials for repairing access to the dam passing through the forest were harmful to the environment, the top court ordered the state to repair the roads themselves using materials that were ecological. Tamil Nadu could publish a civil engineer with his department to monitory work.
“Complete the track repair”
The court ordered Tamil Nad to complete the track repair and asked it to meet the legal requirements under the Inland Acts Act and the law on wild animals while passing another ship.
In the question of grouting, the court asked states to meet with the supervisory committee, which would issue expert recommendations.
In the previous hearing, Apex Court has shown that the prolonged dispute between the state can only be resolved with the intervention of experts with specialized knowledge.
“The main ministers Tamil Nadu and Keral and our Prime Minister can be very respected persons. But in this particular area, we may not have in -depth knowledge. That’s why we wanted experts … Our interest is the security and security of dams,” we noted that the Dipankar Datta, a member of three judges headed with Judge Lach.
