Nirmal Kanti Chakrabarti, who was in 2019, confirmed that a complaint about sexual harassment filed by a member of the Faculty against Dr. Nirmal Kanti Chakrabarti, who was appointed in 2019, should be in 2019 in 2019, which would forever “haunt”.
The Court noted that “bad” could be forgiven, but unforgettable, and ordered Mr. Chakrabarti to declare his judgment, part of his biography personally on Friday.
In the new approach, the bench of judges Pankaj Mithal and PB Varale observed: “It is advisable to forgive a contradictory player, but not to forget the offense.”
“The wrong, which was committed against the petitioner (member of the faculty), must not be investigated for technical reasons, but must not be forgotten,” wrote Judge Mithal, who created the judgment. The petitioner was represented by the leader of the advocate Meenakshi Arara and advocate RISHAD AHMED CHOWDHURY.
“In this view, we order the incidents that the incidents of alleged sexual harassment on part of the opponent No. 1 (Chakrabarti) may be forgiven, but they can persecuted the perpetrators forever. So it is ordered to make this judgment part of the Respondent’s CV.
The judgment concluded that the divisional bench of the High Court in Calcutta did not commit any rights to restore the decision of the local complaint (LCC) that the complaint of a member of the faculty was time -barred and necessary.
LCC rejected a complaint to finding that the last alleged incident of sexual harassment occurred in April 2023. The complaint was filed on 26 December 2023, which was not only for a prescribed limit of three months but also for an extendable period of six months.
Section 9 of the Women’s Sexual Harassment Act (Prevention, Prohibition and Compensation) of 2013 provides that a damaged woman can file a complaint about sexual harassment within three months of the incident and in the case of a number of incidents, within three months of the last incident.
The second station to Section 9 states that LCC may extend the time to file a complaint for another three months for reasons to be recorded in writing.
