The Supreme Court on Thursday (Nov 06, 2025) refused to intervene in the plea of former Uttar Pradesh MLA Mohammed Abdullah Azam Khan, son of Samajwadi Party leader Azam Khan, to quash charges of procuring a passport using forged documents.
“We are not willing to interfere,” Justice MM Sundresh, who headed the bench, told senior advocate Kapil Sibal, who appeared for Mr Khan.
The Allahabad High Court had earlier refused to quash the criminal case, prompting the former MLA to approach the Supreme Court.
“The trial court is free to decide all the issues without being influenced by the order of the High Court,” the Supreme Court bench observed.
BJP MLA Akash Saxena filed a case against Mr Khan in Rampur on 30 July 2019 for alleged fraud and violation of the Passport Act for allegedly obtaining a travel document using an incorrect date of birth.
According to the complaint, Mr. Khan’s passport was issued on January 10, 2018. While the passport showed his date of birth as September 30, 1990, his education certificates showed January 1, 1993.
A case was registered in Rampur district. Mr Khan is facing trial before Special Judge MP/MLA Rampur. The indictment in the case was filed on September 9, 2021.
