
The Karnataka High Court has quashed a lower court’s order transferring Rudragouda Patil (RD Patil), the prime accused in the police sub-inspector recruitment scam, from Kalaburagi Central Jail to Mysuru Jail.
Following the order, RD Patil is to be shifted back to Kalaburagi Jail.
The Chief District and Sessions Court in Kalaburagi on January 27 allowed his transfer on security grounds.
RD Patil’s wife, Shobha, filed a case in the Supreme Court.
A bench headed by Justice S. Vishwajith Shetty, while hearing the petition, observed that transferring a prisoner in a judicial proceeding without giving him an opportunity to raise objections or be heard is a violation of the principles of natural justice.
The court also expressed dissatisfaction with the manner in which the transfer was ordered.
He stated that the use of vague reasons such as security reasons without proper justification and insufficient application of judicial mind by the district judge are not reasonable.
While government counsel argued that the transfer was necessary for security reasons, it was conceded that the prisoner was not allowed to present his case.
In view of this, the Supreme Court ordered that RD Patil be immediately shifted back to Kalaburagi Jail from Mysuru.
