
On Thursday, the Supreme Court urged the central government to set up the courts on the “highest priority basis” to deal exclusively with cases of sexual offenses against children.
The Top Court stated that due to the insufficient number of exclusive courts for hearing the protection of children against sexual offenses (POCO) of the Act on Acts, the timelines under the Act on completion of court proceedings were not observed.
“Therefore, the India and State Governments of the Union are taking relevant steps to sensitization of officials associated with POCO investigating and also to create reserved courts that test cases of POOSO on the highest priority,” said Judge Bela M. Trivedi and PB Varala.
The Top Court listened to the petition based on a “alarming increase in the number of reported rape incidents” in the case of Suo Moto.
The court also ordered the filing of the accusation in the compulsory period stipulated by the Act, in addition to completing legal proceedings in the prescribed time framework.
SC noted that while the majority states with financing from the center met instructions for setting exclusive courts for POCSO cases, Tamil Nadu, Bihar, Uttar Pradesh, West Bengal, Orissa, Maharahtra and several other countries.
Previously, the Supreme Court ordered a higher defense attorney and Amicus Curiae V. Giri and the leader of the Uttary Babbara advocate to submit state data on the status of the POCSO court.
She asked states to establish two designated courts in districts where the number of waiting cases of children’s abuse under the law of POCSO was more than 300.
