A former HSBC employee based in Hong Kong’s office sued the company and claimed that he was racially discriminated against and released after the fears of the Human Resources Department (HR) and the leadership, reported on the press agency Bloomberg on Monday, July 21, 2025.
Former employee, Robert Ngugi Tomkinson, worked as a senior business analyst at HSBC Global Services. In trial proceedings, Tomkinson claimed that in September 2024 he faced “permanent and differential treatment” since his new manager.
According to an agency report quoting documents of the District Court, Tomkinson raised concerns about racial discrimination in a formal internal complaint. The report also mentions that Tomkinson was the only black heritage employee among his peers in society.
What did the company do?
After Tomkinson raised his concerns about racial discrimination, the company carried out an internal investigation that was “partially observed” on February 11, 2025.
According to a report on the agency with the aim, the company Tomkinson’s manager was missing in disproportionately, the investigation did not find any discrimination, but concluded that Tomkinson’s manager was to communicate the former employee of irrelevant parties.
After the investigation, the “PIP) plan, which was launched against Tomkinson, was not implemented and later canceled. Two days later, however, the company informed Tomkinson about his redundancy, which he claimed to be a “retaliation”.
Compensation
A former HSBC employee is looking for compensation from the company and repressive damages under the Race Discrimination in Hong Kong according to the agency report.
Tomkinson did not answer any further questions of the agencies and HSBC representatives said that, according to the Agency report, it is not appropriate for the company to comment on the development before the courts.
Tomkinson also claimed that he was excluded from meetings due to “unsubstantiated” PIP and suffered a loss of duties. The agency report also stressed that other employees in comparable roles and stamps were not selected for redundancies at the same dose.
The agency also quoted that the company is undergoing overhaul. The aim of the CEO of HSBC (CEO), Georges Elheders, is to increase the efficiency and streamline operations of the institutional creditor.
