Soon after taking over the leadership in 2024, Mr. Oram told Hindu that his ministry was dealing with the questions they raised.
At the beginning of this year, the Minister stated that their concerns were “examined” without getting into the details of which aspect he specifically looked at.
A certificate issued
“In the last two months, we have found that the administration in A & Ni has issued a certificate in 2022 with the assertion that FRA rights were identified and settled and that the consent to the diverse land was taken after,” Hindu member said on Friday. The Council is a key representative body of Nicobar people on the islands and regularly interacts with administration.
The Council in the letter to Mr. Oram of 21 July explained that she had not given her consent for the project. “We write to you to inform that the process of settlement of forest rights within the FRA has not been started. Therefore, there is no doubt that forest rights are resolved.” The Council stated that it was recently informed of the “certificate” in August 2022, issued by the Deputy Commissioner of the Nicobar district, who claimed the opposite and therefore sought the intervention of the Minister.
According to this FRA diversion certificate, which was issued on August 18, 2022, the Hindu copy was seen, the administration specifically claimed: “The complete process of identifying and settling rights according to FRA was carried out for the entire Protected Forestry area 121.87 square kilometers and considered the forest of 8.8 square forests.
However, as Hindi reports earlier, the administration in A&F has maintained in front of the Ministry of Major Affairs in its monthly FRA that it does not have to be carried out on the islands, because forests that are already protected under the 1956 native strains (PAT56).
While Pat56 gives the administrators of the islands full of power to divert forest land, FRA requires that such a diversion should be made only after the rights are first resolved, and then consent to take over from the grams concerned. It was not clear whether the forest land was deviated for the project under FRA or PAT56.
The Infrastructure Project on the island has been tired of the discussion since it received a preliminary permit in 2022. Soon after the project was allegedly secured the consent of local tribes, the Tribal Council of Little and Great Nicobar withdrew the consent. The National Green Tribunal and the National Commission for Planned Tribes also subsequently indicated concerns about the procedures for consent to the alleged violation and the impact of the environmental impact project.
The Union government claimed that a proper process was followed in forest commissions for the project. In paperwork on Hindu offense, administration called a special meeting of Gram Sabha 12. August 2022 for the villagers of Laxminagar, Gandhi Nagar and Campbell Bayats, which has undergone a resolution that agreed to divert forest land.
Furthermore, three days later the Sub-Division level committee convened a meeting where a certificate was obtained without a hug on behalf of Shompen Tribespeople, who were represented through the administration of Andaman Adim Janjati Vikas Samiti (AAJVS).
In his letter Tribal Council further said, “Gram Sabha, which is said to have given consent to depart the forests, did not include Nicobarese of the Great Nicobar, whose predecessor Chingenh, Haeng Loi, Pulo Ba, Kokeon, Pulo Pakka, and others will be influenced by the project.”
The Council also stated that the consent of Shompen, classified as a particularly vulnerable tribal group, cannot be obtained through an AAJV officer.
“Examination of other options”
A member who spoke to the Hindus on condition of anonymity, said, “We hope and wait for the Minister to answer our complaint. If he does not come, we will see what other options are available.” The member stated that the Council’s complaint was reinforced by post office on July 30 and added that he also sent E -mail to Mr. Oram, but still had to receive an answer or confirmation.
Several attempts to achieve the Minister’s Office and higher officials have not yet given an answer.
In his letter, the Minister of the Mistal Affairs of the Council also stated that the authorities were made more statements that the Council would cancel its consent, but without success.
When applying for the Minister’s intervention on the protection of “rights, tradition, culture and forests” of Nicoberse and Shompen, the Council said “we do not want the proposed project” to be anywhere in the tribal reserve area or in the areas of Shompen use.
