The Madhya Pradesh High Court overwhelmed the Ministry of Defense of the Union for its “completely illegal” possession of 130 -year -old assets in the Mhow Canton, which directed the defensive goods department to restore the possession of the dispute for petitioners Ann Chandiramani (84) and Arnuna Rodrigues (79).
The only bench of justice Pranay Verma canceled the order of the Court of Appeal of 2024 and noted that the defense property was forcibly evicted by nurses just 24 hours after the lower court rejected its ownership without giving them the opportunity to appeal.
The property, built in 1892, has been the subject of an extended legal battle between nurses and defense property since 1995. In July 2024, nurses moved the Supreme Court after evicting after the rejection of their action for the purpose of setting ownership. In particular, the lower court recognized their ownership rights and ordered eviction.
In an interview with Hindus, Mrs Rodrigues described eviction 21 December 2022 and said: “The lower court order came in the evening and before we could get a copy, the staff of the defense with trucks arrived and forcibly moved us without showing us any documentation.
The Court criticized the lawsuits of defense as an obvious violation of legal procedures and noted that “the defendants were aimed at predictable deprivation of the applicants on their legal remedies”. He added, “Heaven would not fall if the plaintiffs were awarded a reasonable time to seek protection of appeal.”
Mrs. Rodrigues explained that the ongoing dispute over ownership remains unresolved and the High Court regulation only applies to possession. “Our lawyer has already visited MHOW to initiate formalities. If necessary, they will submit a petition at a call at the Supreme Court to ensure holding,” she said.
