The divisional bench of the High Court in Madras on Friday, August 29, 2025) canceled the permission granted by the only judge in 2022 defenders B. Ramkumar Adityan based in Toothuku in 2017 and another individual 2021.
Justices Anita Sumanth and N. Senthilkumar allowed the appeal filed by the Secretary -General of the Party of Edapadi K. Palaniswami against the leave (permission) granted by a single judge two applicants for bringing an action for representative shelter, on behalf of AIADMK members.
The judges stated that the plaintiffs should bring freedom to their individual capacity.
Vijay Narayan, head of K. Gowtham Kumar, representing the petitioner, claimed that the plaintiffs had not shown that they were members of AIADMK, and yet the only judge allowed them to bring an action against the party, also in representative capacity.
After now adopted the appeal to the final hearing, the bench led by Judge Sumanthem ruled that the only judge had committed a mistake when he granted the applicant to file an action for a representative office.
Stating that the authenticity of documents submitted by the plaintiffs to prove the membership of the Party could not be in the preliminary phase of the granting permission to bring the action that the matter could only be decided by the action.
The judge also noticed the submission of two plaintiffs that they had taken a notice of journalists expressing their intention to bring an action in a representative position on behalf of the primary members of AIADMK, but none of them raised any objections to the application.
