The Kerala Public Services Commission approached the Supreme Court challenging the prosecution order and the case registered against the members and employees

The Kerala Public Service Commission (KPSC) approached the Kerala High Court, challenging the prosecution order and subsequently registering a case against KPSC members and employees over alleged irregularities in the appointment of the head (Industry and Infrastructure Department) of the Kerala State Planning Board.

The case registered by the Thiruvananthapuram Crime Branch police station relates to alleged malpractices in the appointment evaluation process.

The petition sought to quash the sanction granted by the government to prosecute the Commission employees and the First Information Report (FIR) registered by the Crime Branch police station.

The commission alleged that the state had sanctioned an inquiry into the alleged malpractice in the evaluation of answer sheets even though no accused had been named in the FIR.

The KPSC maintained that its members could only be removed by the President of India. As an autonomous constitutional body, it was not under the control of the state government.

The petition stated that a Vigilance inquiry into the alleged irregularities found that there was a mistake in the on-screen marking process in the re-examination for the post of Chairman of the State Planning Board. Economics questions were not assigned to the appropriate assessors, resulting in their non-assessment. However, the commission claimed that it had taken corrective measures to correct errors in the ranking and evaluation process.
