It was the Kerala High Court’s intervention that finally helped Nepali national Durga Kami get priority in getting a donor heart.
Single Judge Shoba Annamma Eapen on December 11 ordered the government and the Kerala State Organ and Tissue Transplant Organization to consider Ms. Kami’s priority application as soon as possible.
According to Rule 31(4)(e) of the Transplantation of Human Organs and Tissues Rules, 2014, the order of allocation of organs is as follows – State List, Regional List, National List, Persons of Indian Origin and Foreigners. In the plea filed in the Kerala High Court, it was argued that Ms. Kami was at risk of sudden cardiac death and required a heart transplant as soon as possible. She also lost her older sister to the same disease.
Suffering from a rare and serious heart disease called cardiac sarcoidosis, Mrs. Kami had temporarily settled in Kochi for her treatment and was waiting for a heart donor. Her name was added to the K-SOTTO list for a heart transplant on February 22, 2025.
