The High Court in Delhi denied the deposit of the separatist leader Naye Ahmad Khan, who took place in 2017 in the case of terrorist financing, which concerned the terrorist leader Lashkar-E-Taib Hafiz Saeed.
The Court of Justice said that a long imprisonment of the submission cannot be a reason for a deposit in such cases focused on the destabilization of the country.
“WHILE WE AS AWARE THAT THE RIGHT OF AN UNDERTRIAL TO A SPEEDY TRIAL IS OF PARAMOUNT CONSIDERATION, IN CASES INVOLving Terrorist Activities, WHIC So, to Create Terror in the Minds of General Public, WHICH ALSO FACTORS THAT WEIGH IN THE LONG PERIOD OF INCARCERATION WOULD NOT, IN ITSELF, BE GROUND ENEG TO ENLAGE AN ACCUSED ON BAIL, ”Said The Judgment 9.
The defendant challenged the order of the court court against his request. He claimed that the court proceedings in the near future are unlikely to conclude. He said he should be a bail.

Arrested in 2017
The head of the Hurriyat Khan conference was arrested on July 24, 2017 and is currently in judicial custody.
In the case of registered in 2017, under the counter -terrorism Act, the NIA Act claimed that Art Nouveau has entered a criminal plot to encourage the general public to resort to violence and create an atmosphere for promoting their program in Kashmir Valley.
“Threat for Unity”
The court noted that Prima Facia, the accused person, including Khan, conspired to detach Jamm and Kashmir from the Indian Union through terrorist activities, threatening the unity, integrity and security of the nation. He would notify him that he would be harmful to the public and the security of the public and the court.
The Court acknowledged the documentary evidence, witnesses’ statements and other materials found by the prosecution to conclude that there were reasonable reasons to believe that the accusation against Khan would be true and therefore attracts the limitations of bail under UAPA.
