The executive judge who issued the notice to the student has been suspended, SG informs the high court

Solicitor General of India Tushar Mehta on Thursday informed the Supreme Court of the suspension of the Executive Judge of the Greater Noida Commissionerate who had issued a notice to a Gautam Buddha University (GBU) student in connection with the NEET-UG protests at Jantar Mantar.

The magistrate issued the notification on September 4 despite the Supreme Court’s express order three days earlier, on September 1, barring coercive action against students who participated in the agitation.

On September 9, the apex court made its displeasure clear that a judge had issued a notice to Akshat Tripathi under Section 130 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) in connection with the preventive proceedings.

Mr. Tripathi was asked to show cause why he should not be bound to execute a personal bond of ₹5 lakh with two sureties for allegedly “inciting” classmates to join the Janta cockroach party’s proposed dharna.

The CJI orally observed that the Magistrate’s Court had no power to issue such a notice “when we have already quashed (the FIR) and ordered that no criminal action be taken against any student”.

“It was a clear order. The language was very clear. Every layman understood the order,” Chief Justice Kant observed.

The September 1 order quashed the FIR registered against the protesters, who were overwhelmingly students, involved in the agitation against the NEET-UG question paper leak.

The Supreme Court also barred a fresh FIR against students in connection with the Cockroach Janta Party protests.
