Total delays ranging from 44 days to 474 days were recorded in issuing building permits in local bodies in Kerala, according to the report of the Comptroller and Auditor General of India on Local Government Institutions for the period ending March 2024. The audit noted inordinate delays in dealing with unauthorized constructions by selected local municipal bodies.
Although Kochi Corporation and Aluva, Varkala and Mukkam municipalities were aware of the violation of Kerala Municipal Building Rules (KMBR) in 28 buildings, these buildings were found to be in operation without building permission and occupancy certificate. The Secretaries have not initiated any action to regulate or demolish these buildings. The report states that three urban local bodies have issued approval/permission for 10 structures without securing NOC from the concerned authorities.
During a joint physical inspection, ČAS found 10 unauthorized buildings at four city authorities and 193 unauthorized additions/changes at selected city authorities, which indicated deficiencies in the monitoring mechanism. 1,058 mobile towers remained unauthorized in selected municipal bodies, resulting in a minimum revenue loss of ₹2.12 crore on tower construction fee.
Undetected violations
The audit also noted unauthorized conversion of occupancy following the issuance of planning permission in contravention of the provisions, resulting in substandard recreational space, lift facilities and obstructions. The audit identified a shortage of 1,210 parking spaces in 123 buildings due to the reconstruction of parking spaces and unauthorized additions. In the absence of post-occupancy audits, these violations went undetected by city authorities.
The CAG has recommended that the city authorities introduce strict measures to ensure that building permits and approvals are issued only after the mandatory requirements specified in the KMBR are met. Post-occupancy audits and team activities need to be strengthened and streamlined to effectively detect unauthorized construction and deviations from approved occupancy.
