Justice N. Tukaramji of the Telangana High Court directed the Registry to place before the HC Chief Justice bench a case filed by MLC Chintapandu Naveen alias Teenmaar Mallanna to transfer all cases registered against him in various parts of the state to the Special Court for Hearing Cases Against Public Representatives.
The judge also granted an exemption to Teenmaar Mallanna from appearing before various courts for eight weeks. The MLC filed a plea stating that several criminal cases were registered against him in different parts of the state. He asked the government to transfer all cases pending against him to the court designated as a special court for MLAs and MPs.
Government home plea Mahesh Raje informed the bench that the Supreme Court, in its order in Ashwini Kumara Upadhyay’s case, said cases registered against MLAs and MPs should be heard and disposed of expeditiously by special courts. The Prime Minister claimed that the Supreme Court had categorically stated the cases against MLAs and MPs. The order did not specifically mention the cases registered against the MLC.
However, the MLC’s counsel argued that the MLC should also be treated at par with the MLA and the cases booked against him had to be referred to the designated court for MLAs and MPs for a fair and speedy trial.
