The Madras High Court has disagreed with the Tamil Nadu government’s decision to limit maternity leave to just 12 weeks for the third pregnancy of women who are otherwise entitled to 365 days of leave for two pregnancies.
A Second Division Bench of Justices R. Suresh Kumar and N. Senthil Kumar said there was “absolutely no justification” for the state government to issue a Government Order (GO) on March 13, 2026, limiting maternity leave for third pregnancies to just three months.
