On Monday, June 23, 2025), the Supreme Court decided to explore the “important” problem of existing rules to provide another recovery certificate (CC) to children of free mothers, belonging to the backward parts of society.
“The current petition raises an important problem for issuing a certificate of municipalities to children of free mothers, in which mothers belong to the municipality … it must be heard,” said the bench headed by Judge KV Viswanathan.
The case was filed by a woman based in Delhi and the top court was looking for answers of the Center and the Government of Delhi in January. The Center claimed that the matter required extended consideration and states must be accused as parties in the case before the Supreme Court. The Center stated that the court should be instructions on the question.
The bench set the case for another hearing of 22 July. The 2012 judgment, which dealt with a question that surrounds the status of a person whose parents belonged to planned castes or planned tribes.
Santosh Kumari, a petition, represented by a lawyer Dawneesh Shaktivats, said that the Civil Certificate was not provided on the basis of the mother’s caste identity. The applicant for the Civil Code of Civil Procedure was forced to create a certificate of relatives on the paternal side.
“Inactivity by respondents to issue a certificate of municipalities to the children of free mothers on the basis of his / her certificate of the Civil Code was contrary to the rights of children belonging to the Civil Code,” the action said.
The petition also said that it violates the provisions of the Constitution as a children of a free mother belonging to the planned category of caste/planned tribe on the basis of its certificate.
The petition referred to the Delhi instructions for issuing a certificate of municipalities that required the production of a certificate of municipalities of any related paternity blood, including father, grandfather or uncle.
