The Telangana High Court on Monday issued a notice to Khairatabad MLA Danam Nagender, who was elected on a BRS ticket but later contested the Secunderabad Lok Sabha seat as a Congress candidate, and the Speaker of the Assembly in a writ petition challenging its recent order rejecting Nagender’s disqualification petition.
A bench of Chief Justice Aparesh Kumar Singh and Justice GM Mohiuddin directed the Speaker’s office and Danam Nagender to submit their counter-affidavits in the matter by April 16. BJP House Speaker Alleti Mahesh Reddy, who filed the writ petition, sought a direction to quash and set aside the hearing ban petition issued on March 11. 4 of 2024 relating to Danam Nagender.
The petitioner claimed that the Kharaitabad MLA should be disqualified because the affidavit he filed on 23 April 2024 during the Lok Sabha elections while contesting from Secunderabad claimed that he was the nominee of the Congress party as he was earlier elected as an MLA on a BRS ticket. The petitioner asked the senate for an expedited settlement of the petition in accordance with the judgment of the Supreme Court in related matters.
