
The Supreme Court on Tuesday, February 17, drew attention to the growing use of artificial intelligence (AI) in drafting petitions. The finding that AI was being used to draft petitions was made when the Supreme Court came across some references to cases that either did not exist or were cited incorrectly.
A bench of Chief Justice of India (CJI) Surya Kant and Justices Joymalya Bagchi and BV Nagarathna mentioned during the hearing that some lawyers have started using AI for drafting, Bar and Bench reported.
CJI Surya Kant said, “We are alarmingly told that some lawyers have started using AI for drafting. There was also something with Justice Dipankar Datta. All the precedents mentioned never existed.”
Justice BV Nagarathna recalled a case that does not exist: “There was a case of Mercy vs Mankind which does not exist,” she said, adding another such case, saying: “Then some cite actual Supreme Court cases, but those cited parts do not even exist in the judgment.
The development comes weeks after the court assured that judges are very cautious about using AI and will not allow the technology to take over decision-making.
The chief justice said: “We use it very excessively consciously. We don’t want it to overwhelm our judicial discretion. If you have good proposals, you can put them on the administrative side.”
Meanwhile, Prime Minister Narendra Modi has spoken about concerns over potential AI-induced disruption of the labor market, saying the central government is treating it as a “current imperative” rather than a future problem.
Speaking to ANI, PM Modi said, “I understand the concerns of our youth about AI-induced disruption of the job market. Preparation is the best antidote to fear. That is why we are investing in upskilling and reskilling our people for an AI-driven future. The government has launched one of the most ambitious skills initiatives in the world, but we are not treating this as a current issue.”

“History has shown that jobs will not disappear due to technology. Its nature is changing and new types of jobs are being created. While some jobs may be redefined, digital transformation will also add new technology jobs to the Indian economy. For centuries, there have been fears that innovation and technological revolutions will eliminate jobs. Yet history teaches us that whenever there is innovation, new opportunities emerge. The same will be true in the era of AI-added government,” he added.
