
The Special Court in Assam ordered framing the accusation under the law of the POCSO and other parts of the IPC against the IPS Gaurav Officer Upiphyay in a six -year alleged case of sexual harassment.
Special judge, protection of children from sexual offenses (POCSO) Court, Karbi Anglong, R. Lal, said “there were two incidents of sexual assault on the surviving” accused, who was a superintendent of the police at the time of the incident.
“The first attack appeared in SP Bungalo in Diph. The second attack took place in the hotel room, where the survivor stayed with his mother and brother,” she said.
A copy of the order, which was approved on Wednesday, was made available on Saturday.
In December 2019 there was an incident involving a fourteen -year -old girl and in January 2020 a police case was registered. The Criminal Investigation Department (CID) probed the case and subsequently submitted its cartridge certificate against the IPS official.
Upadhyay, who is currently another secretary of the Ministry of Transport in 2012, comes from the 2012 IPS dose; State Project Director, Assam Inland Water Transport Development Society; and project officer, Assam Integrated River Basin Management.
The judge noted that, given that Upadhyay was Karbi Anglong SP at the time of the incident, this happened within the limits of his jurisdiction and control as a policeman who attracted the provisions (i) and (L) section 9 of the POŠO law and punished the same law under section 10.
The use of the “criminal force to kiss” the victim and “physical contact and progress” by touching its private parts, as stated specifically by the minor in its statement, leads to accusation of sections 354 and 354a of the Indian Criminal Code (IPC).
She also stated that the case has remained in the court for several years, while the forerunner of direct court courts to accelerate such cases with legislation also order the time -tied completion of the court proceedings in the cases of POCO Act.
“Under the circumstances, the accusations according to Section 10 of the POCSO law and sections 354, 354A are framed by IPC,” the special judge ruled.
Section 10 of the POCSO law deals with impaired sexual attacks, while sections 354 and 354A IPC are intended for crimes related to attack or criminal forces on a woman with the intention of outraging her modesty or sexual harassment.
The special judge set out on 21 August as the date for recording the plaintiff on the accusation and the necessary order.
