
The Supreme Court took advantage of its extraordinary powers to complete justice-a 15-time-complaint of motor accidents assigned to a “brave” girl based in Chennai, who lost her mother and suffered extensive injuries in 2010.
The bench headed by Judge Surya Kant told M. Pradeesha fighting with 50% permanent disabilities to lead an independent life after losing her mother in a traffic accident at the age of five in August 2010.
The misfortune occurred when the van in which the mother and daughter moved collided with a truck parked in the middle of the road without any signal or indicator.
In her recent ranking, the bench described in detail the physical and mental challenges that Mrs. Pradeesha, represented by the advocate of PB Sashaankh, dared and watched her academic goals every day.
The court stated that her disability had adversely affected her academics, job prospects and personal life. “The petitioner suffered not only physical pain but also an unchanging mental agony. It requires special food and nutrition to physically cause for its daily routine,” the court added.
In 2017, the lawsuits for accidents for accidents and the Madras High Court ended in 2017.
Mr. Sashaankh claimed that the nature of the permanent partial disability guaranteed a more holistic compensatory framework that dealt not only with the health costs but also the future gainful capacity and educational failure. Insurance companies, in turn, questioned the extent of the disability and questioned the credibility of the petitioner’s medical certificate.
“We allow this appeal to the extent to which the petitioner is, except for what he has been awarded by the Tribunal and the High Court, entitled to a lump -sum compensation from 15 Lakh, which the insurance company will pay,” the Supreme Court ordered.
