SBI knocks on HC’s door over state government selling five acres of land ‘allotted to it earlier’
Justice NV Shravan Kumar of the Telangana High Court will on Thursday hear two pleas filed by the State Bank of India challenging the sale of its five acres of land through e-auction by the state government.
The SBI filed the two petitions in the form of lunch motions two days ago seeking to set aside the sale of land located at the Hyderabad Knowledge Center at Raidurg in Rangareddy district. The judge directed the registry to record the pleas for Thursday after special government pleader Rahul Reddy sought time to get directions in the matter.
Senior advocates BS Prasad and N. Venkatraman appeared for the SBI. They claimed that in 2010, the then undivided Andhra Pradesh government had allotted five acres of land in Raidurg to the State Bank of Hyderabad (which eventually merged with SBI) for construction of offices and other complexes. SBH paid a sale consideration of ₹13.33 crore and other charges, after which the then AP Industrial Infrastructure Corporation Limited issued an allotment certificate.
A land sale agreement subject to certain conditions was entered into between APIIC and SBH to this extent in 2011. SBI lawyers said that a bank branch building and three ATM centers were constructed on the said lands and other building construction schedules as per the terms of the agreement were submitted to the government.
However, on January 22, 2021, the government issued a procedure to cancel the land allocation. The SBI moved the HC, which stayed the cancellation notice, and directed the government to consider the bank’s plea and pass appropriate orders. According to the SBI counsels, the cancellation proceedings issued by the government in 2021 in connection with the HC order have lapsed in law.
In another written proposal from the HK bank, he directed the government to consider the bank’s request to initiate steps to implement the building authority project at the site. The government appealed in the matter, but the HC upheld the earlier orders, according to the bank.
Meanwhile, the government issued an e-auction notification for the sale of the land on May 6 and the land was sold, SBI claimed.
