President Manithaneya Makkal Katchi MH Jawahirullah said on Tuesday that the rejection of the Supreme Court remained some aspects of the WAQF Act (amendment), 2025, was “deeply disappointing” because “unfortunately approved several harmful amendments”. He said that the decision “does not achieve complete constitutional protection”.
In his statement, he stated that the court selectively addressed 44 changes established by the BJP government in parliament and left most of the “regressive provisions untouched”. “Although the court remained certain provisions, it failed to impose a temporary stay of many others that violates the foundations of the Constitution. This is a deeply disappointment. The court also decided that up to 4 non-Muslims could sit on the 22-member WAQF, and up to 3 non-Muslims on state councils … Hinductions with hinductions with hinductions with hinductions with hinductions that are on the basis of hinductions, or up to 3 non -Muslims on the state.
Professor Jawahirullah welcomed the court’s decision to remain in a amendment that requires a person to prove that Islam followed at least 5 years before the creation of WAQF. “However, by leaving state governments to define who qualifies as a Muslim, the judgment seizes government for Muslims to limit who can create a waqf and set a dangerous precedent,” he said.
He said that the temporary order of the “WAQF user” would be alarming and said that centuries -old mosques and cemeteries that have been determined by continuing use faced an existential threat. “In particular, paragraphs 143-152 of the judgment further complicated this problem.
Professor Jawahirullah called the WAQF law (amendment) conspiracy for weakening and usurp waqf properties and demanded its cancellation in its entirety.
