New Delhi: A new bill seeking to authorize online registration of ground documents and other transactions provisions, an alternative verification mechanism for those who do not or do not want to use their Aadhaar according to its content.
The bill is replaced by a 117 -year registration act of 1908.
The draft law prepared by the Ministry of Land resources, the Ministry for Rural Development, which was included in public feedback, represents the provisions to support online registration, electronic presentation and acceptance of documents, issue electronic registration certificates and digital maintenance of records.
It allows you to verify Aadhaar with informed consent, but also alternative mechanisms of verification for people who do not have Aadhaar or decide not to use it. The bill also enables electronic integration with other record keeping systems.
Under the Registration Act, documents concerning immovable property such as sales list, gift list, mortgage documents and rental must register. Wills, authority and other judicial decrees and orders concerning ownership rights are also subject to registration.
The bill extends the scope of compulsory registration to reflect current property and transaction procedures and expands the list of required documents, according to government officials.
It also modernizes the organizational structure of the registration system with a more sensitive hierarchy, including the introduction of general and assistant inspectors of registration.
The bill provides for the appointment of the General Inspector of Registration, Registrars and Subregistrars, streamlining the process of appointing registrars in the case of vacancies and causing the power to create a government with the relevant government to ensure that the local administration is reconciled.
It promotes the preparation of a simple language, digital permits and transparent procedures to make the registration process more accessible, especially for individual citizens and small businesses, the officials said.
While this law requires documents to be submitted to the Registration Office, the new bill of law states that these documents can be submitted “in person or by electronic means”.
The current law requires people to register documents to attach a photo and fingerprint to the document to the document.
According to the new bill, the individual will connect to the document of his signature, a color photo of the size of the waist, or to obtain photography with a digital camera and inch impression, whether manually or through a biometric device, to submit a permanent account number (PAN).
The bill stipulates that a person representing any registration document can attach physical signatures, electronic signatures under the Information Technology Act of 2000 or other forms of signatures (whether physical or digital), as prescribed.
It is also said that any person who represents any document may undergo AADHAAR authentication based on consent or verification based on offline or verification based on consent through officially valid documents or equivalent e-documentaries under applicable laws.
No person will be rejected for registration for having no Aadhaar number, says the bill.
In the public interest and prevents fraud, the government may require persons to carry out such documents notified by electronic means to physically appear in front of the registration official, before issuing a registration certificate, the bill said.
It also defines the conditions in which the registration may be rejected and provides a mechanism for appeal against the rejection of the registration.
The bill has a provision that allows the registration office to “other infrastructure” necessary to facilitate registration, such as computers, scanners and cloud storage.
