The protest of the implementation is the right of every citizen and must be exercised by obtaining permission from the competent authorities in accordance with the law, observed the Maduraj bench of the Madras High Court.
The Court of Justice rejected the petition that B. Ramkumar Adityan of Tiruchendur, who was looking for a direction in February, to limit the joint Action of the Tamil Nadu Teachers Organization and the Government Employees (Jactto-Geo) members of protests in violation of the rules and take steps if they carry out a protest.
The JUSTICES SM SU SU SUBRAMANIAM and AD Maria Clete Bench noted that the attached direction that seeks measures against persons involved in strokes or agitation cannot be granted in the petition.
If no illegality, inconsistency or crime has been delivered during the disturbance, the relevant measures will be initiated according to procedures as stipulated under the law. However, there is no omnibus relief, as required in the petition, the court noted and rejected the petition.
The petitioner said Jactto-GEO announced at his state meeting in Tiruch that the protests would be held throughout the State 25 February and seek their charter requirements, including the recovery of the old pension system and downloading a new one.
On previous occasions, the protesters blocked the roads in many places and disrupted the free movement of the public. No one can push the government to accept the requirements, and it is a well -established legal principle that there can be no right to call or promote a strike that interferes with the basic freedoms of other citizens, except that in many respects it causes national loss, the petitioner said.
