Almost five months after CPI (M) John Brittas wrote Interior Minister Amit Shah, who was looking for a probe in cyberbullying Foreign Minister Vikram Misri during the Sindoor operation, the Police in Delhi sought him proof to justify his complaint.
In response to the request of the police Dilli, Mr. Brittas presented “Screenshots, web links and press releases”. In a letter addressed by the police commissioner (special cell) Manishi Chandra, he also pointed out that, according to Bharatiya Nagarik Surraksha Sanhit, 2023, when information concerning cognitive offenses is accepted.
Section 173 of the Bharatiya Nagarik Surraksha Sanhita, 2023, Mr. Brittas in His Letter Mentions, States That Every Information Relating to the Commission of A Cognisable Offnce Can Be Given by Any Person, Irrespective of the Area is the Office is Committed, to the officer in-chage of a Police Station, Eier Orally, in Writing, OR Electronic Communication. “BNSS does not limit such reports only to direct victims of a crime. Once this information is received, it is obliged to limit it to the police to write it, enter it in the prescribed register and act according to it,” wrote.
He further pointed out that the in question and threatening positions were already in the public sphere and the media was largely reported. “Insist that the complainants themselves must be provided confirming evidence, contrary to the spirit of section 173, BNSS. The police cannot give up their legal obligation by shifting the burden of proving eligible offenses to the informant in the threshold,” Brittas wrote.
