A fresh Public Interest Litigation (PIL) was filed in the Kerala High Court on Tuesday, seeking the removal of the word “Kerala” from the title of the Hindi film The Kerala Story 2 – Goes Beyond.
The petitioners, a retired social studies teacher and a lawyer, also mentioned that the filmmakers had challenged in the division court the recent order of the Single Bench, which issued an interim stay on the release of the film allegedly before its release.
The single judge granted a fortnight’s interim stay, observing that the trailer had a prima facie potential to distort the public perception of Kerala and disrupt communal harmony. After hearing the appeal against the stay order, the division bench allowed the screening of the film. He observed that once the censor certificate was issued, there was a prima facie presumption that the Central Board of Film Certification (CBFC) had taken into account all the guidelines regarding its content.
In a PIL filed on Tuesday, the petitioners alleged that apart from showing Kerala in a bad light by allegedly portraying it as a center of forced conversions, the film may incite hatred against members of the Muslim community in the state.
The petitioners further sought a High Court directive to the Center and the CBFC to allow the screening of the film stating that it was based on a purely fictional subject. They also sought a directive for the Center and the CBFC to lay down guidelines to ensure that film titles and captions do not defame any state, region, caste or religion.
